By renting this house you agree to the following terms and conditions:
REMINDER NOTICE: You are responsible for printing and bringing the reminder
notice that we will email to you when your final payment is received. The
reminder notice will have the physical address of the community for your
GPS, gate access instructions, the door entry code as well as some other
important information. If you have not received this reminder notice with
you final payment confirmation you must let us know prior to your arrival
date.
DOOR ENTRY CODE: The house has an electronic lock on the entry door with a
numeric keypad. Your entry code will be active from 4PM on your arrival
date through 10AM on your departure date. Your door code will be provided
in your reminder notice that will be emailed to you upon your final
payment.
CHECK IN is at 4:00 PM or after.
If you are checking in after 11 PM, you must let us know as soon as
possible by phone or text.
CHECK OUT is at 10:00 AM or earlier.
You must check out by 10:00 AM or we reserve the right to remove any
luggage and other personal belongings from the house.
OWNER: Owner shall provide all utilities, furnishings, towels, linens and
starter bathroom supplies. Owner is not responsible for any utility or
cable/internet interruptions during the guests stay but will make every
attempt to have the utility/cable company restore their services as soon as
possible.
GUEST: Guest agrees to leave unit in the same condition as found. Furniture
must be in the same location as when you arrived. Dishes, pots and pans
must be properly cleaned as to not have any baked on food, all trash (water
bottles, boxes, bags etc) must be picked up and put out for the trash
during your stay and upon departure. Any damage to the unit will be your
responsibility. You are responsible for making sure the condo is properly
secured at all times. Owner assumes no liability for property loss or
damage, nor liability for accidents or injury.
The house will be inspected before your arrival and immediately after your
departure.
NUMBER AND IDENTITY OF GUESTS:
Guest is informed and understands that the maximum number of guests
permitted to stay in the Unit at any one time is set by state and local
ordinances and/or fire codes, and no exceptions can be made. Should Magic
Box discover that maximum occupancy is more than the unit's lawful
permitted number of guests, Magic Box will charge said Guest a penalty, a
NON REFUNDABLE eviction process will take place for breach of this
Agreement. The maximum number of guests permitted to stay in the Unit at
any one time cannot exceed as determined below:
PROCEDURES
If you experience a minor problem in your unit, one that does not require
an urgent repair as defined below,
please direct your request for repair to the agency with which you
booked your reservation.
If you experience an issue that requires an urgent repair, please contact
Magic Box Vacation to resolve the problem. Urgent repairs fall into two
categories: essential urgent services and other urgent repairs. Essential
services repairs include broken Air Conditioning, a burst water service,
broken hot water system, sewerage leaks or dangerous electrical faults.
Other urgent repairs are those that are not an essential service, but might
cause damage to the premises, injure a person or cause undue hardship or
inconvenience to the guests, like appliances or electronics, not working.
Once you notify Magic Box Vacation of the need for an urgent repair, we
will take action to contact a suitable repairer and arrange for them to fix
the problem. Magic Box Vacation has 24 hours to do this if the repair is
needed to a defined essential services, and 18 hours for any other urgent
repair. The repair may not happen within this time but Magic Box Vacation
will make an appointment with the repair technician to fix the problem.
Magic Box Vacation will then ensure that the repairs are carried out as
soon as practicable after the arrangements have been made . In case of
maintenance problems, please report as soon as possible by sending an email
to
maintenance@magicboxvacation.com
or leave a detailed voice mail with your name, phone number and the unit
number you are staying at (407) 308-0206.
If there is an emergency which threatens the life or health of an occupant,
or the imminent destruction of the property itself, please immediately
contact emergency services at 911.
ADDITIONAL INFORMATION/ OBLIGATIONS.
SUPPLIES:
Our properties are initially equipped with a standard set up of supplies
such as of 01 paper towel, 01 dishwasher detergent (for one use) and trash
liner, hand soap and toilet paper in all bathrooms. After the house runs
out of these supplies, the guest is responsible for replacing them for the
rental period.
CHECK OUT PROCEDURES:
Turn the lights, televisions and stereos OFF. Make sure the coffee pot is
OFF. Make sure all the faucets are OFF. CLOSE and LOCK the windows and
doors. Leave everything in the place you found it when you arrived. All the
extra garbage during your stay and at your check out needs to be taken to
the Resort dumpster. Otherwise a fee of USD $100 will be
charged to the credit card on file. Trash collection rules will be sent
with the reservation confirmation email.
PROPERTY CLEANING AND MAINTENANCE:
The property will be cleaned before your arrival and we recommend you to
please leave the house in good cleaning conditions and organization during
your stay and at your check out. Mid Stay Cleaning are available for
additional charge and can be requested within 48hrs by email
info@magicboxvacation.com
.
ROUTINE MAINTENANCE:
During your stay, an authorized Magic Box Employee may need to enter the
property with our maintenance crew or vendors, during reasonable hours to
perform critical maintenance service on equipment or make repairs. No
courtesy calls are given
POOL HEATING:
(when available) service must be requested and prepaid with 48hrs prior to
the use. Client most be aware that it takes 6-8hrs to reach temperature and
it also depends on the weather
conditions outside. Refunds are not made for inclement weather.
OWNER CLOSET:
The property may contain a locked owner's closet for the Owner's personal
use and is not a part of this rental. Please do not try open, any damage or
theft will be charged to the credit card on file related to this agreement.
AIR CONDITIONING:
For efficient A/C please keep ALL doors and windows closed. Set A/C
temperature between 72/78 in Auto/Cool position. Any lower setting will
cause the A/C unit to freeze up, causing considerable damage to unit. Any
repairs will be charged against your Security Deposit or the credit card on
file. During the winter months the A/C may be switched to be Auto/Heat
position and adjusted temperature as needed. For heating: 74-76ºF degrees
should be comfortable for sleeping.
REPAIR ISSUES:
Should any equipment malfunction or maintenance issue occur; we will make
every effort to have it repaired as soon as possible. Problems in the
rental homes will be handled in a timely and professional manner but are
subject to availability to of vendors and contractors
PETS - NO ANIMALS ARE PERMITTED IN THE UNIT
Should Magic Box discover that the Guest is staying at the "Unit" with an
animal Magic Box will charge said Guest a penalty and an eviction process
will take place for breach of this agreement. An additional fee for carpet
cleaning, hygienization and deep cleaning must be paid as an additional
rental cost before check in date. The cost for extra cleaning may change
depending of the unit size used in the context. Should Magic Box discover
that Guest permitted an animal to enter the Unit after Guest has vacated
the Unit. Guest's credit card will be charged and Guest will be liable for
additional fines and costs.
SMOKING.
In accordance with the Florida laws and for the comfort of all our guest,
SMOKING IS NOT ALLOWED inside the Unit or the pool area. Guest specifically
agrees that violations of this non-smoking requirement will result in
charge of up USD $2,000.00 charged to the Guest's Credit
Card plus Magic Box or the property owner may bring legal action to
compensate for additional damages to the property and furnishings caused by
smoking.
CONDOMINIUM STANDARDS.
Is obliged the Guest, to act in accordance with the provisions in the
condominium rules, being responsible for civil and criminal, for the
duration of this instrument. The Guest agrees to pay before the check-out,
all expenses incurred in the property, restaurant, cafeteria, supermarket,
cinema, video arcade, heliport, marina, clubhouse, made by you or any of
your other guests. The closure of the daily does not imply discharge of the
expenses described herein. The maximum speed of vehicles driving in the
condominium is 10 miles/hour. The driving of vehicles by people without
specific qualifications is not allowed. It should be observed by the Guest
the legal period of quiet hours from 10:00 PM to 07:00 AM.
ASSIGNABILITY: GOVERNING LAW.
This Rental Agreement is for the exclusive use of the Unit by Guest and
his/her family, and the Unit may not be sublet or assigned to any third
party without the express written approval of Magic Box. This Agreement is
shall be governed by and is enforceable under the laws of the State of
Florida and for any action, venue is proper in the courts of Osceola County, Florida. If any portion of this agreement
is held by a court of law to be unenforceable, it shall be severed from the
agreement and the rest shall remain in full force and effect.
SUBSTITUTIONS.
In case of incidents beyond our control, severe damage or sale of the
property, Magic Box reserves the right to substitute the property to a
similar or superior accommodation near the original one without further
liability.
LOST AND.
Magic Box Vacation is not responsible for any items left
in the unit. We will do our best to find your item, but cannot guarantee
this and no refund is due by Magic Box to the guest. Guest is responsible
for picking up any item(s) left in the unit. Magic Box will hold the
item(s) for no longer than 5 business days.
CONSTRUCTION.
Unfortunately, we cannot predict construction activities near our
properties. We may not be able to notify the guests prior to arrival. There
are no refunds because of construction or renovations activity.
CANCELLATION POLICY.
The Lessee may cancel your booking at any time before or during the stay.
If the tenant decides to cancel your reservation, the Lessor reserves the
right to apply the following cancellation fees:
The date of booking up to 60 days prior to check-in 10%
Between 60 and 30 days of check-in date 50%
Less than 30 days from the date of check-in 100%
In addition to the cancellation fee percentage will be charged the amount
of credit card fees, PayPal or bank deposit. There will be no refunds due
to weather problems, early check-out, interruption of any service or
maintenance problems.
• Cleaning fees are always refunded if the guest did not check in.
• The Magic Box Vacation insurance fee is non-refundable.
• Accommodation fees (the total nightly rate you're charged) are refundable
in certain circumstances as outlined below.
• If there is a complaint from either party, notice must be given to Magic
Box Vacation within 24 hours of check-in.
• A reservation is officially canceled when the guest clicks the
cancellation button on the cancellation confirmation page.
• Cancellation policies may be superseded by the Guest Refund Policy,
extenuating circumstances, or cancellations by Magic Box Vacation for any
other reason permitted under the Terms of Service. Please review these
exceptions.
• Applicable taxes will be retained and remitted.
